PV PROPERTIES LLC
GUEST RENTAL POLICIES AND TERMS OF STAY

These Guest Rental Policies and Terms of Stay apply to reservations made directly with PV Properties LLC through StayLakeCumberland.net, by telephone, by text message, by email, or through another approved booking method.

By submitting a reservation request, making a payment, checking the acceptance box, or occupying a PV Properties LLC rental property, the person making the reservation, referred to as the “Guest,” agrees to these policies on behalf of themselves and every person included in or permitted to enter the property during the reservation.

1. RESERVATION ELIGIBILITY AND GUEST RESPONSIBILITY

---

The Guest making the reservation must:

* Be at least 18 years old and legally capable of entering into a binding agreement.
* Provide accurate contact, payment, occupancy, and reservation information.
* Have authority to accept these policies for all members of the Guest’s party.
* Remain responsible for the conduct, safety, and compliance of all occupants, visitors, children, pets, and other persons allowed onto the property.

The person making the reservation is the primary Guest and is financially responsible for all amounts owed under these policies.

PV Properties LLC may require identification, confirmation of the names and ages of occupants, vehicle information, or other reasonable information before approving or continuing a reservation.

2. RESERVATION CONFIRMATION

---

Submitting a reservation request does not guarantee that the requested property or dates are available.

A reservation is confirmed only after PV Properties LLC has:

* Approved the reservation.
* Issued a written confirmation.
* Received any required deposit, advance payment, or full payment.

PV Properties LLC may decline a reservation request when:

* The property is unavailable.
* Payment cannot be processed.
* Information provided is incomplete or inaccurate.
* There is reasonable concern that these policies or the property’s house rules will not be followed.

3. RATES, TAXES, FEES, AND PAYMENTS

---

The Guest agrees to pay the rental rate, taxes, cleaning charges, processing fees, deposits, and other charges displayed or communicated during the booking process.

Depending on the property, reservation dates, length of stay, and booking method, PV Properties LLC may require:

* Full payment at the time of booking.
* An advance reservation deposit.
* A scheduled payment plan.
* A refundable security deposit.
* A payment card to remain on file.
* Another payment arrangement stated in the reservation confirmation.

When only a deposit is collected, the remaining balance must be paid by the due date shown in the reservation confirmation.

Failure to pay the balance when due may result in cancellation of the reservation. Any refund will then be determined under the cancellation policy that applied to the reservation.

The Guest authorizes PV Properties LLC and its payment processor to charge the approved payment method for amounts due under the reservation and these policies, to the extent permitted by law and the applicable payment-processing agreement.

4. CANCELLATION POLICY

---

Cancellation requests must be submitted in writing by email or another written communication method approved by PV Properties LLC.

CANCELLATIONS MORE THAN 14 DAYS BEFORE CHECK-IN

Cancellations received more than 14 full calendar days before the scheduled check-in date will be handled according to the refund terms shown in the reservation confirmation.

Unless the reservation confirmation states otherwise, eligible payments will be refunded, less any payment-processing charges, third-party booking fees, or other charges that are not returned to PV Properties LLC.

CANCELLATIONS WITHIN 14 DAYS OF CHECK-IN

Cancellations received 14 calendar days or fewer before the scheduled check-in date are non-refundable.

The Guest will not receive a refund, credit, transfer, or rescheduling of the reservation for:

* Cancellations within the 14-day non-refundable period.
* Failure to arrive.
* Late arrival.
* Early departure.
* Personal illness or emergency.
* Changes in work or travel plans.
* Weather conditions.
* Road conditions.
* Lake levels or lake conditions.
* Closure or unavailability of marinas, restaurants, attractions, or other third-party services.
* Any other circumstance outside the control of PV Properties LLC.

PV Properties LLC may make an exception at its discretion, but an exception in one situation does not require an exception in another.

Guests are encouraged to purchase independent travel insurance when protection against unexpected cancellation is desired.

5. RESERVATION CHANGES

---

Changes to the property, arrival date, departure date, or number of occupants are subject to availability and approval by PV Properties LLC.

A request to change dates does not suspend or restart the cancellation period.

PV Properties LLC may treat a material date change as a cancellation of the original reservation and the creation of a new reservation.

The Guest may not sell, transfer, assign, or give the reservation to another person without written approval from PV Properties LLC.

6. CHECK-IN AND CHECK-OUT

---

Check-in and check-out times will be provided in the reservation confirmation or property instructions.

Guests may not enter the property before the approved check-in time or remain after the required check-out time without written permission.

Unauthorized early entry or late departure may result in additional charges, including:

* Cleaning costs.
* Additional rental charges.
* Expenses caused by delaying the arrival of another guest.

At check-out, Guests must follow the departure instructions provided for the property, including requirements involving:

* Trash.
* Dishes.
* Keys.
* Doors and windows.
* Thermostats.
* Grills.
* Fire pits.
* Other property features.

7. OCCUPANCY AND VISITORS

---

Occupancy may not exceed the maximum number shown in the property listing or reservation confirmation.

Only registered Guests may stay overnight.

Parties, receptions, reunions, commercial gatherings, and other events are prohibited unless PV Properties LLC has provided prior written approval.

The Guest must obtain permission before allowing unregistered visitors onto the property. The Guest remains responsible for all visitors and their conduct.

Exceeding the occupancy limit, holding an unauthorized event, or allowing unauthorized overnight guests may result in immediate termination of the stay without a refund.

8. HOUSE RULES AND GUEST CONDUCT

---

Guests must treat the property, its contents, neighboring properties, and the surrounding community with care and respect.

The following are prohibited:

* Illegal activity.
* Disorderly, threatening, dangerous, or disruptive behavior.
* Excessive noise.
* Unauthorized parties or events.
* Tampering with locks, smoke detectors, security devices, internet equipment, appliances, utilities, or safety equipment.
* Moving furniture or equipment outside without permission.
* Use of the property for commercial photography, filming, sales, or business operations without approval.
* Fireworks.
* Discharge of firearms or other weapons.
* Activities that create an unreasonable risk of injury, fire, damage, or disturbance.
* Any violation of applicable laws, community rules, property instructions, or written directions from PV Properties LLC.

Quiet hours and property-specific rules may be included in the reservation confirmation or posted inside the property. Those rules are incorporated into these policies.

9. NO-SMOKING POLICY

---

Smoking is prohibited inside all PV Properties LLC rental properties.

Smoking may also be prohibited in designated outdoor areas, near doors or windows, on certain decks, or near combustible materials.

Guests must dispose of smoking materials safely and may not leave cigarette butts or other waste on the property.

Evidence of indoor smoking may result in charges for:

* Deodorizing.
* Deep cleaning.
* Air treatment.
* Damaged furnishings.
* Lost rental time.
* The minimum damage administration and convenience fee described below.

10. PETS AND SERVICE ANIMALS

---

Pets are permitted only when expressly approved for the specific property and included in the reservation.

Guests are responsible for:

* Controlling approved pets.
* Supervising approved pets.
* Cleaning up after approved pets.
* Preventing pet-related disturbances.

Guests are financially responsible for pet-related:

* Damage.
* Stains.
* Odors.
* Waste.
* Excessive cleaning.
* Pest treatment.
* Injuries.
* Disturbances.

Service animals will be accommodated as required by applicable law.

Guests remain responsible for the supervision and conduct of a service animal and for damage caused by the animal.

Misrepresenting a pet as a service animal is prohibited.

11. CHILDREN AND SUPERVISION

---

Children must be supervised by a responsible adult at all times.

PV Properties LLC does not provide childcare or guarantee that a property is childproof.

Guests are responsible for evaluating potential hazards before allowing children to use or approach them, including:

* Stairs.
* Decks.
* Furniture.
* Playground equipment.
* Fire features.
* Outdoor areas.
* Roads.
* Water hazards.
* Other property conditions.

High chairs, pack-and-plays, air mattresses, and similar items are provided as convenience items.

The Guest is responsible for inspecting these items before use and ensuring that they are appropriate for the intended occupant.

12. PROPERTY CONDITION AND REPORTING PROBLEMS

---

Guests should inspect the property shortly after arrival and promptly report:

* Existing damage.
* Missing items.
* Unsafe conditions.
* Maintenance problems.
* Cleaning concerns.
* Malfunctioning appliances or amenities.

Problems should be reported as soon as reasonably possible using the following contact information:

Guests must not attempt repairs, alterations, or modifications unless specifically authorized by PV Properties LLC.

Failure to promptly report an issue may limit the ability of PV Properties LLC to correct it and may make it difficult to determine whether damage existed before the Guest’s arrival.

13. DAMAGE, MISSING ITEMS, AND EXCESSIVE CLEANING

---

Normal wear from ordinary and responsible use is expected.

However, the Guest is responsible, to the maximum extent permitted by law, for damage, loss, excessive cleaning, or other costs caused by:

* The Guest.
* Any occupant or visitor.
* Children.
* Approved or unauthorized pets.
* Negligence, misuse, or failure to follow instructions.
* Smoking.
* Unauthorized occupancy or events.
* Missing, removed, or relocated property.
* Stains, odors, trash, bodily fluids, food, grease, mud, or other conditions requiring additional cleaning.
* Damage to buildings, furnishings, appliances, linens, landscaping, vehicles, recreational items, neighboring property, or other property.
* Any violation of these policies or the property’s house rules.

The Guest may be charged for:

* Actual repair costs.
* Replacement costs.
* Labor.
* Service calls.
* Shipping.
* Cleaning.
* Deodorizing.
* Pest treatment.
* Waste removal.
* Lost rental income.
* Management time.
* Collection expenses.
* Other reasonable costs resulting from the incident.

MINIMUM DAMAGE ADMINISTRATION AND CONVENIENCE FEE

When damage, missing property, excessive cleaning, unauthorized activity, or another violation requires additional inspection, documentation, communication, repair coordination, cleaning coordination, or management time, the Guest will be charged a minimum $100 damage administration and convenience fee, to the maximum extent permitted by law.

This minimum fee is in addition to, and does not replace or limit, the Guest’s responsibility for the full cost of damage, cleaning, replacement, lost rental income, or other losses.

PV Properties LLC may provide photographs, invoices, estimates, receipts, or other supporting documentation when reasonably available.

14. SECURITY DEPOSITS AND ADDITIONAL CHARGES

---

PV Properties LLC may collect a security deposit or retain an approved payment method on file.

A security deposit does not limit the Guest’s financial responsibility.

When the amount owed exceeds the security deposit, the Guest remains responsible for the unpaid balance.

PV Properties LLC may apply a security deposit to amounts properly owed under these policies.

Any remaining refundable balance will be returned after the property has been inspected and outstanding charges have been evaluated, generally within 14 days after check-out, subject to payment-processor and banking delays.

The Guest authorizes PV Properties LLC to charge the payment method on file for documented amounts owed, where permitted.

When a charge cannot be processed, the Guest agrees to pay the invoice by the stated due date.

15. SAFETY AND ASSUMPTION OF RISK

---

Vacation properties and the Lake Cumberland area may contain natural and man-made hazards, including:

* Stairs and steps.
* Decks, porches, balconies, and railings.
* Uneven, wet, icy, or slippery surfaces.
* Gravel, grass, wooded areas, and rural terrain.
* Wildlife, insects, and plants.
* Fire pits, fireplaces, grills, and hot surfaces.
* Roads, driveways, parking areas, boats, trailers, and vehicles.
* Water, weather, storms, wind, and falling limbs.
* Recreational equipment and outdoor activities.
* Conditions commonly associated with rural homes and lake-area travel.

The Guest voluntarily assumes the ordinary and inherent risks associated with:

* Occupying the property.
* Using available amenities.
* Participating in recreational or outdoor activities.

Guests must:

* Use reasonable care.
* Follow all instructions.
* Supervise children.
* Discontinue use of any area or item that appears unsafe.
* Immediately report dangerous conditions.

16. INJURIES, ACCIDENTS, AND LIMITATION OF LIABILITY

---

To the fullest extent permitted by law, PV Properties LLC and its owners, members, employees, contractors, and representatives are not responsible for accidents, injuries, illnesses, death, theft, loss, or damage arising from:

* A Guest’s actions, negligence, misuse, or failure to follow instructions.
* The actions of another occupant, visitor, neighbor, or third party.
* Recreational activities.
* Natural conditions, wildlife, weather, or acts of God.
* Personal medical conditions.
* Criminal activity by third parties.
* The loss or theft of personal property.
* Interrupted utilities, internet service, or third-party services.
* Circumstances outside the reasonable control of PV Properties LLC.

Nothing in these policies is intended to waive or limit liability that cannot legally be waived, including liability resulting from fraud, gross negligence, willful misconduct, or another obligation that applicable law does not permit PV Properties LLC to exclude.

17. INDEMNIFICATION

---

To the extent permitted by law, the Guest agrees to defend, indemnify, and hold harmless PV Properties LLC and its owners, members, employees, contractors, and representatives from claims, liabilities, losses, damages, and reasonable expenses arising from:

* The Guest’s stay.
* The actions of occupants or visitors.
* A violation of these policies.
* Damage caused by the Guest’s party.
* Illegal, negligent, reckless, or intentional conduct.
* An injury or loss caused by someone for whom the Guest is responsible.

This provision does not apply to liability that cannot legally be shifted or waived.

18. PERSONAL PROPERTY AND LOST ITEMS

---

PV Properties LLC is not responsible for lost, stolen, misplaced, or damaged personal property.

Guests should:

* Secure vehicles and personal belongings.
* Remove all personal belongings at check-out.

PV Properties LLC may make a reasonable effort to locate and return a lost item.

The Guest is responsible for:

* Shipping.
* Packaging.
* Handling.
* Administrative costs.

Unclaimed items may be discarded, donated, or otherwise disposed of after a reasonable period.

19. AMENITIES, UTILITIES, AND INTERNET

---

PV Properties LLC makes reasonable efforts to keep advertised amenities operational.

However, the availability of the following cannot be guaranteed at all times:

* Internet.
* Television.
* Appliances.
* Grills.
* Fire pits.
* Recreational items.
* Water.
* Electricity.
* Heating.
* Air conditioning.
* Other amenities.

Temporary service interruptions or the failure of a nonessential amenity do not automatically entitle the Guest to a refund.

Guests must notify PV Properties LLC promptly and allow a reasonable opportunity to investigate or correct the problem.

20. WEATHER, EMERGENCIES, AND EVENTS BEYOND CONTROL

---

PV Properties LLC is not responsible for:

* Weather.
* Road closures.
* Utility interruptions.
* Governmental action.
* Natural disasters.
* Epidemics.
* Transportation disruptions.
* Marina closures.
* Lake conditions.
* Other events outside its reasonable control.

If the reserved property becomes unsafe or unavailable before or during the stay, PV Properties LLC may:

* Offer a comparable substitute property when available.
* Adjust the reservation.
* Provide a credit.
* Refund the affected unused portion of the reservation.

The remedy selected by PV Properties LLC will be the Guest’s exclusive remedy to the extent permitted by law.

21. OWNER AND MANAGEMENT ACCESS

---

PV Properties LLC and its authorized representatives may enter the property when reasonably necessary to:

* Respond to an emergency.
* Protect persons or property.
* Perform urgent maintenance.
* Investigate a reported problem.
* Verify compliance with occupancy or house rules.
* Address suspected damage or unlawful activity.
* Complete another lawful and reasonably necessary management function.

Except in emergencies or situations requiring immediate action, reasonable efforts will be made to notify the Guest before entry.

22. TERMINATION OF STAY

---

PV Properties LLC may immediately terminate a reservation or require Guests and visitors to leave when there is:

* Nonpayment.
* Fraud or material misrepresentation.
* Excessive occupancy.
* An unauthorized party or event.
* Illegal or dangerous activity.
* Significant disturbance.
* Threatening or abusive conduct.
* Intentional property damage.
* Refusal to follow safety instructions.
* A serious or repeated violation of these policies.

When a stay is terminated because of the conduct of the Guest or the Guest’s party, no refund will be issued except where required by law.

The Guest remains responsible for damage, cleaning, fees, and other amounts owed.

23. THIRD-PARTY RESERVATIONS

---

Reservations made through Airbnb, Vrbo, Booking.com, or another third-party platform may also be governed by that platform’s:

* Terms and conditions.
* Payment procedures.
* Cancellation rules.
* Claim procedures.
* Dispute requirements.

When these policies conflict with a mandatory requirement of the platform through which the reservation was made, the platform’s applicable requirement will control only to the extent necessary to resolve that conflict.

For direct reservations made through StayLakeCumberland.net or directly with PV Properties LLC, these policies and the written reservation confirmation control.

24. ELECTRONIC COMMUNICATIONS AND RECORDS

---

The Guest agrees to receive reservation-related communications by email, telephone, or text message using the contact information provided.

These communications may include:

* Payment notices.
* Booking confirmations.
* Check-in instructions.
* Property information.
* Emergency messages.
* Follow-up communications related to the stay.

Checking the acceptance box and submitting a reservation request constitutes the Guest’s electronic acceptance of these policies.

PV Properties LLC may retain:

* Reservation information.
* The acceptance date and time.
* The policy version accepted.
* Payment records.
* Communications.
* Other information reasonably necessary to administer and document the reservation.

25. GOVERNING LAW AND DISPUTES

---

These policies and any direct reservation with PV Properties LLC are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles.

Before filing a legal claim, the parties agree to make a reasonable good-faith effort to resolve the dispute directly.

Unless applicable law requires otherwise, any legal proceeding concerning a direct reservation or stay must be brought in a court with proper jurisdiction serving the Kentucky county in which the rental property is located.

26. SEVERABILITY AND NO WAIVER

---

If any provision of these policies is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in effect.

Failure by PV Properties LLC to enforce a provision in one instance does not waive the right to enforce it in another instance.

27. ENTIRE AGREEMENT

---

These policies, the property listing, the reservation confirmation, the payment terms, and any property-specific written rules constitute the agreement between PV Properties LLC and the Guest.

Property-specific terms or written terms shown during booking may supplement these policies.

When a property-specific written term directly conflicts with a general provision, the more specific written term will control.

Changes are valid only when confirmed in writing by PV Properties LLC.

## GUEST ACKNOWLEDGMENT AND CHECKBOX LANGUAGE

Required Checkbox:
